Trump Set to Sign Legislation Targeting Revenge Porn and Explicit Deepfakes

President Donald Trump is set to sign the Take It Down Act, a bipartisan law designed to enforce harsher penalties for the distribution of non-consensual explicit imagery, including deepfakes and revenge porn. This legislation aims to criminalise the publication of such materials, regardless of whether they are genuine or generated by artificial intelligence. Offenders could face significant consequences, including fines, imprisonment, and orders for restitution.

Under the stipulations of this new law, social media platforms and online services are mandated to remove any identified harmful content within 48 hours upon notification from the affected individual. Furthermore, they are required to implement measures to eliminate duplicate posts of such content.

While several states have already prohibited sexually explicit deepfakes and revenge porn, the Take It Down Act represents a critical shift, marking the first instance of federal intervention to govern the behaviour of internet companies in this area. The bill received support from First Lady Melania Trump, and was championed by Senators Ted Cruz (R-Texas) and Amy Klobuchar (D-Minnesota). Cruz’s motivation for the legislation stemmed from an incident involving Snapchat, which had reportedly delayed for nearly a year in removing an AI-generated deepfake depicting a 14-year-old girl.

Despite its intentions, the bill has sparked criticism from free speech advocates and digital rights groups. They argue that its broad definitions may inadvertently allow for censorship of legitimate content, including lawful adult materials, as well as suppress voices that criticise government actions. As such, the implications of the Take It Down Act could extend far beyond its original intent, raising important questions about the balance between protecting individuals and preserving freedom of expression online.
