Trump Administration Officially Reverses Biden’s Regulations on AI Distribution

The U.S. Department of Commerce (DOC) has officially retracted the Biden Administration’s Artificial Intelligence Diffusion Rule, which was due to take effect on May 15. Initially proposed by then-President Biden in January, this rule aimed to impose new export restrictions on U.S.-made AI chips, categorising countries into tiers based on their reception of these technologies.

On Tuesday, the DOC announced it would no longer enforce the previous regulation, signalling plans to introduce a new framework focusing more on diplomatic negotiations with specific nations rather than applying stringent blanket restrictions. This represents a strategic pivot in policy direction.

Under the Biden rule, countries were categorised into three tiers. Tier 1 nations, such as Japan and South Korea, would have faced no limitations on chip exports, while Tier 2 countries, including Mexico and Portugal, would have been subjected to new export controls for the first time. Tier 3 nations, notably China and Russia, would have experienced even stricter limitations.

In the absence of robust new regulations, the DOC provided guidance to the industry, reinforcing that the usage of Huawei’s Ascend AI chips violates U.S. export laws. It highlighted the risks associated with allowing U.S. AI chips to be employed in training AI models in China and advised on safeguarding chip supply chains against diversion tactics.

Jeffery Kessler, U.S. Secretary of Commerce for Industry and Security, declared that the Trump Administration seeks to develop a dynamic and inclusive strategy regarding American AI technology, prioritising partnerships with trusted allies while preventing adversaries from accessing these advanced technologies. He further critiqued the previous administration’s approach, labelling it as poorly conceived and unproductive.

This significant policy shift underscores the evolving landscape of international tech diplomacy and the ongoing debate regarding the exportation of advanced technological capabilities in the realm of artificial intelligence.
