The investigation by the U.S. Department of Labor (DOL) into Scale AI’s adherence to the Fair Labor Standards Act (FLSA) has been closed, according to sources connected to the case. The FLSA serves to protect workers from being incorrectly classified as independent contractors and ensures fair wage compensation. The inquiry concerning Scale AI was initially revealed by TechCrunch in March.

Additionally, two of Scale AI’s HR partners, Upwork and HireArt, were also under scrutiny from the DOL for FLSA compliance issues but have since been cleared of investigation, as both companies confirmed to TechCrunch.

Scale AI, which boasted a valuation of $13.8 billion last year, relies on a significant workforce classified as contractors for essential tasks, such as image labeling for major tech firms. However, the company has faced legal challenges from former workers who claim they were misclassified and underpaid, which denied them access to crucial benefits like sick leave.

While the precise reasons behind the DOL’s decision to halt the investigation remain unclear, it is worth noting recent shifts in the DOL’s stance. The agency hinted at a more lenient interpretation regarding the classification of workers, having announced a temporary cessation of enforcement of a previous rule established during the Biden administration that made contractor classification more stringent.

In a statement, Scale AI’s spokesperson, Joe Osborne, expressed satisfaction with the DOL’s resolution, emphasising that fostering new employment forms within the AI sector is critical to the nation’s economic advancement. Osborne highlighted the importance of the flexible earning opportunities that Scale AI aims to provide through its platforms.

The DOL has not commented on the closure of the investigation or the driving factors behind it. However, amidst these developments, Scale AI is perceived to be aligning itself more closely with the Trump administration. CEO Alexandr Wang has been involved with the administration in the past, attending Trump’s inauguration and advocating for a strong U.S. position in AI technology.

Notably, Scale AI’s former managing director, Michael Kratsios, was appointed to lead the White House’s Office of Science and Technology Policy earlier this year, where he advises the president on science and technology matters, although this position does not involve oversight of the DOL.

As it stands, while Scale AI has managed to move past the immediate investigation concerns, the broader context of worker classification remains a significant discourse within the tech industry and government policy.
