Epic Games’ highly successful title, Fortnite, is set to make its return to the US iOS App Store next week, following a noteworthy ruling in its prolonged legal dispute with Apple. The conflict began in 2020 when Apple expelled Epic from its App Store over the company’s attempt to implement direct payment options within Fortnite, aimed at circumventing Apple’s substantial 30% fee on in-app purchases.
In 2021, Judge Yvonne Gonzalez Rogers ruled that Apple could not block developers from including links that would direct customers to alternative payment methods outside the Apple ecosystem, effectively reducing the need to pay Apple’s fees. However, nearly four years later, the same judge declared that Apple was in “willful violation” of her previous injunction, highlighting its refusal to adhere to the legal directive.
Judge Rogers expressed her discontent, stating that Apple’s assumption that the court would overlook its noncompliance was a grave error. She emphasised that attempts to conceal violations would only worsen the situation for Apple.
Despite this ruling in 2021, Fortnite did not return to the App Store, with Epic’s CEO, Tim Sweeney, stating that the game would re-enter the marketplace only when it could offer in-app payment options that compete fairly with Apple’s, thereby benefiting consumers. Following the latest unexpected ruling from Judge Rogers, Sweeney announced that Fortnite will finally be available to iOS users in the United States.
Sweeney remarked, “Apple’s 15-30% junk fees are now as dead in the USA as they are in Europe under the Digital Markets Act. Unlawful here, unlawful there,” celebrating the lengthy battle that took precisely four years, four months, and seventeen days to achieve a favourable outcome for developers and consumers alike.
With this significant ruling, the landscape for digital transactions on platforms like iOS is set to shift, potentially allowing developers more freedom and competitive pricing models while challenging Apple’s long-standing revenue practices. The return of Fortnite to iOS signifies a crucial victory not just for Epic Games, but for a broader movement advocating for fairer conditions in the app marketplace.
