Epic Games is intensifying its campaign against Apple to facilitate the re-entry of its popular game Fortnite into the App Store. In a recent court submission, Epic has urged Judge Yvonne Gonzalez Rogers to compel Apple to “accept any compliant version of Fortnite” in the U.S. App Store. This legal tussle, which has persisted for several years, primarily revolves around Apple’s App Store commission fees for in-app purchases.
Last month, Epic achieved a noteworthy legal win when Judge Rogers declared Apple to be in “willful violation” of an injunction regarding anti-competitive pricing. This ruling not only appeared to open the door for Fortnite’s potential return to the App Store but also indicated that developers might soon have more freedom to provide alternative payment methods within their apps.
However, Apple has signalled its intent to appeal this ruling. Recently, Epic announced it would be halting Fortnite’s availability in the U.S. App Store and would not be launching it on the Epic Games store in Europe. The company lamented that “Fortnite on iOS will be offline worldwide until Apple unblocks it.”
Apple contested this assertion, clarifying that it had requested Epic Sweden to update the app submission by removing the U.S. App Store component, in order to not disrupt Fortnite’s availability in other regions.
The question remains: why block Fortnite in the U.S. specifically? A letter from Apple’s attorney, Mark A. Perry, indicated that the company would not progress the Fortnite app submission until the Ninth Circuit resolves an outstanding request for a partial stay of the new injunction.
In its court filings, Epic argues that Apple is obstructing its ability to benefit from pro-competitive changes, effectively punishing the company for challenging Apple’s entrenched practices, and sending a discouraging message to other developers who might consider similar actions.
As both companies pursue their respective legal strategies, the outcome remains pivotal for app developers and the broader digital marketplace, potentially reshaping the landscape of competitive app distribution.
