Deel Requests Rippling to Transfer Any Agreements Related to Payments to the Alleged Spy

Deel has intensified its legal confrontation with rival HR tech startup Rippling by filing a motion in an Irish court demanding disclosure of key information. Central to Deel’s request are unredacted witness affidavits, including a notable one from former Rippling employee Keith O’Brien. This affidavit, revealed by Rippling, alleges O’Brien’s admissions of covertly aiding Deel while employed at Rippling, adding a dramatic twist to the proceedings.

Rippling initiated the legal battle against Deel in March, accusing it of misappropriating trade secrets, engaging in tortious interference, and unfair competition. Much of this lawsuit is anchored in the alleged spying claims. In response, Deel has countersued, asserting that Rippling’s case should be dismissed on various grounds, including issues of jurisdiction, while also bringing its own allegations of espionage against Rippling.

In the letters released publicly on Monday, Deel referenced an affidavit from Vanessa Wu, Rippling’s former general counsel. Her testimony detailed supposed espionage-related incidents and her insights into the exchanges between the legal teams of both companies. Notably, Wu disclosed that Rippling terminated O’Brien and compensated him with a termination fee in exchange for a non-suit agreement. Furthermore, she indicated that Rippling later entered a second agreement to cover O’Brien’s legal fees related to his cooperation in the case.

Deel is pressing the court to compel Rippling to provide full unredacted copies of these agreements. The company aims to highlight the unusual circumstance of a fired employee receiving compensation as a witness, raising questions regarding the integrity of Rippling’s actions.

Both parties are staunchly defending their positions, accusing each other of misconduct. As the case unfolds, attention will be on the court’s decisions, particularly regarding the potential release of O’Brien’s testimony and the details of the termination agreements. The outcome of this legal drama, rife with allegations and counter-allegations, remains to be seen.
