On Friday, Coinbase announced that the U.S. Securities and Exchange Commission (SEC) has agreed to dismiss its lawsuit against the company with prejudice, preventing the case from being refiled. This development, pending approval from the SEC’s Commissioners, suggests a shift in regulatory attitudes towards cryptocurrency under the current Trump administration, contrasting with the previous stance taken by former SEC Chair Gary Gensler.

The SEC’s lawsuit, initiated in 2023, accused Coinbase of operating as an unregistered national securities exchange, broker, and clearing agency by classifying crypto assets as securities. In response, Coinbase mounted a robust defence, arguing that the SEC had failed to provide clear regulations for the cryptocurrency sector, which undermined its ability to enforce compliance.

Coinbase CEO Brian Armstrong shared insights on social media, recalling the widespread advice in 2023 against engaging in litigation with the SEC due to the substantial costs involved. He revealed that the company ended up spending around $50 million on legal defence, a point which validated concerns about the financial toll of such a battle. Armstrong suggested that his fight was motivated by a desire to protect the future of the cryptocurrency industry in the U.S., citing that many other firms lacked the financial resources that Coinbase possessed.

A Coinbase spokesperson clarified that the reported legal expenses solely covered external legal fees, excluding the internal costs related to employee time. Despite their apparent victory in this legal battle, Armstrong expressed the need for comprehensive legislation to regulate cryptocurrency more effectively in the U.S. He warned that without such regulatory clarity, the country risks lagging behind its global counterparts in the increasingly competitive crypto landscape.
