Apple Faces Lawsuit for Discontinuing CSAM Detection in iCloud

Apple is facing legal action due to its choice not to introduce a system that would have scanned iCloud photos for child sexual abuse material (CSAM).

The lawsuit contends that by not taking greater steps to thwart the dissemination of this material, Apple is compelling victims to relive their trauma, as reported by The New York Times. The complaint characterizes Apple as having announced “a widely praised redesign aimed at safeguarding children,” yet subsequently failing to “execute those designs or take adequate actions to detect and curtail” this content.

Originally, Apple unveiled the system in 2021, outlining its use of digital signatures from the National Center for Missing and Exploited Children and other organizations to identify known CSAM in users’ iCloud databases. However, the company appeared to retract those efforts after privacy and security advocates raised concerns that such a system could facilitate government surveillance.

The lawsuit is reportedly filed by a 27-year-old woman using a pseudonym. She alleged that a family member abused her as an infant and disseminated images of her, stating that she continues to receive notifications from law enforcement almost daily regarding charges against individuals possessing those images.

Attorney James Marsh, who is participating in the lawsuit, mentioned that there could be a potential group of 2,680 victims eligible for compensation in this matter.

TechCrunch has reached out to Apple for their response. A company representative informed The Times that Apple is “urgently and actively innovating to combat these crimes without compromising the security and privacy of all our users.”

In August, a 9-year-old girl and her guardian filed a lawsuit against Apple, alleging the company’s negligence in addressing CSAM on iCloud.
