Uber Takes Legal Action Against DoorDash, Claiming Anti-Competitive Practices

Uber, the leading ride-sharing company, has initiated a lawsuit against DoorDash, alleging that the food delivery service is undermining competition by coercing restaurant owners into exclusive partnerships.

In a lawsuit filed in the California Superior Court, Uber asserts that its main competitor has intimidated restaurants into committing exclusively to DoorDash. The lawsuit claims that DoorDash, which dominates the U.S. food delivery market, threatens restaurants with hefty penalties that could reach millions of dollars or risks reducing their visibility on the DoorDash platform.

Uber contends that DoorDash pressures eateries into forming exclusive or nearly exclusive partnerships for their first-party delivery services. This means DoorDash insists on managing all orders made through the restaurants’ own websites, according to Uber.

A DoorDash representative responded to the allegations on Friday, stating in an email to TechCrunch, “Uber’s claims lack merit and are baseless, stemming from their failure to provide merchants, consumers, or couriers with a viable alternative.”

Both DoorDash and Uber Eats are recognized for their respective applications that connect restaurants, customers, and gig economy workers. Through these apps, consumers can order a variety of foods—from pizza to egg rolls to pad thai—and gig workers then pick up and deliver these meals.

In addition to their core services, the companies also compete through their white-label delivery solutions—Uber Direct and DoorDash Drive-on-Demand—both introduced in 2020. These offerings are less expensive for restaurants, allowing customers to place orders via the restaurants’ websites or apps while Uber and DoorDash manage the delivery logistics behind them.

According to Uber’s lawsuit, DoorDash is responsible for handling first-party deliveries for over 90% of America’s largest restaurant chains and has allegedly employed anticompetitive strategies to dominate the market.

“Over one million partners collaborate with Uber Eats because we have enhanced their customer outreach and given them the flexibility to expand their delivery channels as they see fit,” stated Sarfraz Maredia, Uber’s head of delivery for the Americas, in an email statement. “We’re increasingly receiving feedback from restaurants that DoorDash’s methods are restricting their choices and penalizing them for seeking out better alternatives. We hope this lawsuit will put a stop to these unjust practices, allowing restaurants to choose what best aligns with their goals without fear of repercussions.”

Uber is seeking a jury trial, although the company has not disclosed the damages it is pursuing in the complaint.
