Pavel Durov, the entrepreneur behind the messaging app Telegram, found himself under formal scrutiny in France on Thursday, following a four-day detention by police, facing multiple criminal allegations.

Upon his release, Durov was instructed not to exit French borders while the investigation is ongoing. A €5 million bail (approximately $5.6 million) was imposed, alongside a mandate that he report to a local police station biweekly.

The Paris criminal court, which is spearheading the investigation, publicized the accusations contributing to Durov’s arrest on August 24 after his arrival at Le Bourget Airport in France via a private jet.

Central to these charges are allegations related to his company’s involvement in hosting and disseminating child sexual abuse material (CSAM), aiding in drug trafficking, facilitating organized fraud, among other illicit activities. Charges related to the registration of Telegram’s cryptographic operations were also noted.

In a formal announcement, Paris prosecutor Laure Beccuau confirmed the spectrum of charges and acknowledged the progression of the investigation, indicting Durov’s formal suspect status.

Placement under formal investigation in the French legal framework is an essential step towards potentially bringing a case to trial, though it doesn’t guarantee a trial will ensue. Lack of substantial evidence could result in the investigation being dropped.

Beccuau’s statement elucidates the rationale behind Durov’s police custody, indicating Telegram’s involvement in various criminal offences and its poor response to judicial requests, particularly highlighted by the organized crime national court (JUNALCO).

The reluctance of Telegram to collaborate with law enforcement on criminal cases led to a preliminary investigation, as echoed by other French investigative bodies, Eurojust partners, and notably by Belgian authorities, prompting JUNALCO to scrutinize Telegram executives’ criminal accountability.

February 2024 saw the inception of a preliminary probe by the Paris court, designating OFMIN to lead the investigation, subsequently undertaken by the Centre for the Fight against Cybercrime (C3N) and the Anti-Fraud National Office (ONAF).

This narrative finds confirmation in Politico‘s reporting, which indicated the genesis of Durov’s legal troubles tied to a separate child sex abuse probe. In this context, a suspect confessed to using Telegram for exploiting minors, which was compounded by the platform’s non-cooperation with French legal inquiries.

Further, Telegram declined to comment on Durov’s apprehension and the ensuing legal challenges.

Failure to Moderate Content

The inquiry into Telegram broadened during the preliminary phase, examining the application’s wider activities. Currently boasting 950 million monthly users, the platform’s scant moderation mechanisms have come under fire.

Telegram’s alleged moderation lapses, combined with its refusal to assist legal authorities, incriminate its role in facilitating the spread of CSAM, drug trades, and fraudulent schemes, according to accusations by the Paris court.

David-Olivier Kaminski, representing Durov legally, refuted the accusations, labeling any attempts to hold Durov culpable for unrelated criminal activities as baseless. However, this does not clarify Telegram’s initial non-compliance with legal demands.

Amongst the various charges, Durov also faces allegations of money laundering, possibly linked to the platform’s cryptocurrency functionalities and a lack of adherence to financial regulations.

Telegram offers a digital currency, Stars, for purchasing content, which can be exchanged for Toncoin, a cryptocurrency associated with Telegram, and traded across multiple exchanges.

Given the case’s complexities, the investigation is anticipated to extend over several months, if not longer, necessitating Durov’s presence in France throughout its duration.
