A report by the French TV network TF1 highlighted the primary concerns surrounding Telegram, which include its moderation practices and a lack of cooperation with law enforcement agencies, particularly in matters involving narcotics, money laundering, and the dissemination of child sexual abuse images.

The Paris criminal court, spearheading the investigation, likely did not anticipate the whirlwind of attention and conjecture that followed. X’s billionaire proprietor, Elon Musk, tweeted “#FreePavel” in support, while NSA whistleblower Edward Snowden suggested that Durov’s detainment was politically motivated by French President Emmanuel Macron.

The incident has sparked interest among both Russian governmental bodies and opposition factions, given Telegram’s significant user base in Russia and Ukraine, as reported by The Moscow Times.

Amidst public scrutiny, the court issued a press statement outlining the allegations against Durov, initiated by the Paris Public Prosecutor’s Office on July 8 to address cybercrimes. The C3N and ONAF are among the agencies involved in the case, leading to an array of 12 indictments against “a person unnamed,” referring to the incumbent head of Telegram.

These allegations span four main areas:

  • Durov is implicated in crimes related to the harboring and distribution of CSAM, abetting drug trade and organized deception, among other illicit deals.
  • Moreover, Telegram is accused of not cooperating with legal authorities upon the submission of official requests for information or documents.
  • Several charges pertain to the app’s encryption technologies which haven’t received formal recognition or approval from French regulators, deemed as minor infractions by professor Florence G’sell.
  • Additionally, Durov is charged with engaging in a “criminal association to commit crimes or offenses penalized with five or more years of imprisonment,” including money laundering.

These charges are simultaneously comprehensive and intricate, making it challenging to grasp their full extent without complete case details.

It is likely that the accusations regarding CSAM, narcotics, and fraud stem from the perceived insufficiencies in Telegram’s moderation mechanisms. Telegram, boasting 950 million active users monthly, has limited moderation tools despite Durov revealing a mere 30 engineers oversee the app, during an interview with Tucker Carlson.

Regarding the money laundering allegation, Telegram recently introduced a digital currency, Stars, redeemable for user-generated content and convertible to Toncoin, Telegram’s cryptocurrency for premium services.

Incorporating a crypto wallet within the app, Toncoin is tradable on several exchanges, suggesting the investigation may explore possible non-compliance with “know your customer” norms in Telegram’s crypto transactions, potentially facilitating money laundering.

One particular charge mentioned by Prosecutor Laure Beccuau speaks to the “Complicity — offering, selling, or making available equipment or tools without legitimate grounds, designed for unauthorized access or harm to data processing systems,” further complicating the case.

What remains clear amidst these allegations is that Durov’s arrest stems from a criminal probe, rather than being related to the Digital Services Act (DSA) or other specific technological regulations within the EU — delineating that the arrest wasn’t politically motivated, as emphasized by Macron in a recent post on X.

Looking ahead, French law permits a maximum detention of 96 hours for interrogation purposes, after which a decision on formal indictment on any or all charges will be made.

Considering Durov’s affluent lifestyle, owning multiple passports and a private jet, authorities might deem him a flight risk, potentially leading to his continued custody pending trial outcomes.
